WASHINGTON CELL PHONE LAW CHANGING JULY 1, 2008

Effective July 1, 2008 Washington State is enacting a new law making you guilty of a traffic infraction if you use your cell phone while operating an automobile without some sort of hands free device (speaker phone, headset, or earpiece).

Drivers are exempt in some situations, including emergencies.

This infraction is going to be a “secondary action” which means they already pulled you over or detained you for a separate suspected violation.

The infraction will not become part of your driving record.

Cell phone infractions will not be made available to insurance companies or employers.

Cell phone records will be checked if there is any suspicion that one was in use at the time of an accident.

Fine is currently estimated to be $101.00

In a 2006 study done by National Highway Traffic Safety Administration and Virginia Tech Transportation Institute, nearly 80 percent of crashes and 65 of near-crashes involve some form of driver inattention within three seconds before the crash.
